Title VII of the Civil Rights Act prohibits employmentdiscrimination on the basis of sex, race, color, national originand religion. There are two cases currently pending before the U.S.Supreme Court asking the court to interpret the meaning of \"sex\" inthe context of employment discrimination. In R.G. & G.R. HarrisFuneral Homes Inc. v. Equal Employment Opportunity Commission(Links to an external site.), the Court is asked to decide ifdiscrimination based on a person's transgender status is addressedin the Act as discrimination based on \"sex\" as the law is intendedto operate. Meanwhile, in Bostock v. Clayton County, Georgia (Linksto an external site.), the Court is asked to decide whether sexualorientation is included under \"sex\" according to Title VII. In twoor three paragraphs (minimum four sentences each), please give youropinion on the following: 1. Whether Congress could have intendedthe term \"sex\" to include sexual orientation and/or transgenderstatus when the law was written; and 2. Whether the courts shouldnow interpret the term \"sex\" to include sexual orientation and/ortransgender status.
